Land Dispute Settlement (Requesting Court to Discharge the Case as Parties Settled Amicably)
This Settlement
Agreement (“Agreement”) is made and entered into on this [Date] by
and between:

Recitals
WHEREAS, Party A and
Party B are involved in a dispute over the inheritance of plots of land located
at [Address/Description of the Plots] (“Disputed Plots”);
WHEREAS, both parties
wish to resolve this dispute amicably and avoid further litigation;
NOW, THEREFORE, in
consideration of the mutual covenants and promises herein contained, the
parties agree as follows:
1. Settlement Terms
1.1 Ownership and
Possession: Party A agrees to transfer full ownership and possession
of the Disputed Plots, located at [Address/Description of the Plots], to Party
B. This transfer shall include all rights, titles, and interests associated
with the Disputed Plots. Party A shall execute all necessary documents,
including but not limited to, a deed of transfer, to effectuate this transfer.
The transfer shall be completed within [Number] days from the date of this
Agreement.
1.2 Compensation: Party B agrees
to pay Party A a total sum of PKR [Amount] as compensation for the transfer of
ownership and possession of the Disputed Plots. The payment shall be made in the
following manner:
· An initial payment of
PKR [Initial Amount] shall be made upon the signing of this Agreement.
· The remaining balance
of PKR [Remaining Amount] shall be paid in [Number] equal installments of PKR
[Installment Amount] each, due on the [Day] of each month, starting from [Start
Date].
· All payments shall be
made via bank transfer to Party A’s designated bank account [Bank Account
Details].
· Party B shall provide
Party A with written confirmation of each payment made.
1.3 Withdrawal of Court
Case: Both parties agree to withdraw all pending court cases
related to the Disputed Plots. Each party shall bear its own legal costs and
expenses incurred in connection with the litigation.
1.4 Mutual Release: Upon execution
of this Agreement and fulfillment of the terms herein, both parties release and
discharge each other from any and all claims, demands, and causes of action
related to the Disputed Plots.
1.5 Trusted Witnesses: This Agreement
shall be signed in the presence of the following trusted witnesses who shall
attest to the amicable settlement:

2. Representations and
Warranties
2.1 Authority: Each party
represents and warrants that it has the full legal right, power, and authority
to enter into this Agreement and to perform its obligations hereunder.
2.2 No Further Claims: Each party
represents and warrants that it has not assigned or transferred any claim or
interest related to the Disputed Plots to any third party.
3. Governing Law
This Agreement shall be governed by and construed following the laws of Pakistan, including but not limited to the Transfer of
Property Act 1882, the Specific Relief Act 1963, and the Limitation Act 19081.
4. Dispute Resolution
Any disputes arising
out of or in connection with this Agreement shall be resolved through mutual
consultation and negotiation. If the parties are unable to resolve the dispute
amicably, the matter shall be referred to arbitration in accordance with the
Arbitration Act, 1940.
5. Entire Agreement
This Agreement
constitutes the entire agreement between the parties with respect to the
subject matter hereof and supersedes all prior agreements and understandings,
whether written or oral, relating to such subject matter.
6. Amendments
No amendment or
modification of this Agreement shall be valid unless made in writing and signed
by both parties.
7. Execution
This Agreement may be
executed in counterparts, each of which shall be deemed an original, but all of
which together shall constitute one and the same instrument.
